Understanding the Kenya Digital Nomad (Class N) Work Permit

Introduction  

Kenya has become a popular destination for many foreigners seeking to live and work in a vibrant and welcoming environment. However, to legally reside in Kenya, foreigners must hold valid immigration status. Recognizing the rise in remote work, the Kenyan Government recently introduced the Digital Nomad (Class N) Work Permit. This permit is tailored for freelancers and remote workers employed by organizations based outside Kenya. It suits professionals such as IT specialists, project managers, virtual assistants, online educators, software developers, graphic designers, marketers, and similar roles. 

Who is Eligible for the Class N Work Permit? 

The Digital Nomad Work Permit is intended for individuals who meet the following criteria: 

  • Remote Employees: Individuals who are employed under a valid contract with a foreign company (i.e. a company not registered or operating in Kenya); 
  • Business Owners or Shareholders: Foreigners who own shares in or represent a foreign-registered company conducting business outside Kenya; and 
  • Freelancers or Consultants: Self-employed professionals who offer services to international clients and derive their income from abroad. 

The Key Requirements; 

  • Comprehensive cover letter from the applicant addressed to the Director of Immigration Services stating the nature of employment or business location and duration of stay; 
  • Signed cover letter from the employer/company/organization addressed to the Director General of Immigration Services; 
  • Foreign employment contract where applicable; 
  • Employer/company/organization registration/identification documentations; 
  • If a shareholder or conducts business on behalf of a foreign company to produce the company documentation and all the constitutive documents; 
  • Bank Statement/Payslips for last three (3) months proving monthly income; 
  • Proof of residence in Kenya (such as hotel bookings or a lease/rental agreement); 
  • Letter of no objection from local embassy of home country; 
  • Company details; Physical address, telephone number, email address. Contact person, Name, Job title, telephone and email; and 
  • Any other necessary supporting document. 

Conclusion 

Prospective applicants should be aware that the Digital Nomad (Class N) Work Permit strictly prohibits engaging in any employment or income generating activities within Kenya. It is intended solely for individuals working remotely for entities based outside the country. Those seeking to work locally must apply for the appropriate work permit. Additionally, applicants must ensure they meet all specified requirements and provide sufficient evidence to satisfy the Director of Immigration Services that they fully qualify for the permit.
